Welcome to the official Terms and Conditions of Trade for Destin Constructions! Since our beginnings in 1991, we’ve proudly been a trusted part of Melbourne’s construction community for over thirty years. This document is here to explain the agreement between Destin Constructions (“we,” “us,” “our”) and you, our valued client (“you,” “your,” “the Client”).
When you choose our services, it means you’ve read, understood, and agree to these terms. Definitions & Interpretation
In these Terms and Conditions, unless the context otherwise requires:
- “Contract” means the agreement between us and you for the supply of Works, comprising these Terms, the Quotation, and any plans and specifications.
- “Quotation” means our written estimate for the Works.
- “Works” means all construction, renovation, building, and related services to be performed by us, as detailed in the Quotation.
- “Site” means the location where the Works are to be carried out.
- “Client” refers to the person, persons, or entity engaging Destin Constructions.
Acceptance & Formation of Contract
A Quotation provided by Destin Constructions is valid for 30 days and constitutes an invitation to treat.
A binding Contract is formed only when:
- You provide written acceptance of the Quotation; and
- You pay any required deposit as specified.

Quotations, Pricing & Variations
The price in the quotation is based on the specifications, plans, and information available at the time of the quotation. We are a trusted Melbourne builder, and our quotes are comprehensive. However, the price may vary due to::
- Changes in the scope of Works requested by you (a “Variation”).
- Unforeseen site conditions (e.g., hidden rock, poor soil, asbestos discovery).
- Changes in the cost of materials beyond our control.
All Variations must be requested in writing and will be priced based on current rates. A written Variation order will be issued for your approval before proceeding.
Payment Terms & Schedule
A deposit, as specified in the Quotation, is required to secure your project commencement date and order materials.
Following the deposit, progress payments will be invoiced at key milestones of the project (e.g., slab down, frame stage, lock-up).
- Invoices are payable within 7 days of the date of issue.
- Final payment is due upon practical completion of the Works.
- We offer multiple secure payment methods for your convenience.
Permits, Approvals & Compliance
Unless otherwise agreed, the Client is responsible for securing all necessary planning and building permits, consents, and approvals from the relevant authorities.
Destin Constructions, as your trusted construction partner, will oversee all aspects of the build to ensure full compliance with the Victorian Building Authority (VBA), the National Construction Code (NCC), and all other pertinent Australian Standards.
Construction Program & Delays
We will provide an estimated construction timetable. While we, at Destin Constructions, aim to stick to all schedules, the timetable is an estimate and not a firm completion date. Destin Constructions shall not be responsible for delays caused by factors beyond our reasonable control, including but not limited to: extreme weather, strikes, lockouts, material shortages, or delays in the issuance of permits by authorities.
Defects & Warranty
We stand by the quality of our workmanship. Destin Constructions provides a statutory warranty in accordance with the Domestic Building Contracts Act 1995 (Vic) and other relevant state legislation. Upon practical completion, a thorough inspection will be conducted. You will be given a defects liability period, during which we will rectify any faults in materials or workmanship that become apparent, provided they are reported in writing.
This warranty is in addition to any manufacturer’s warranties on appliances and materials used.
Client Responsibilities
To ensure a smooth and efficient build, the Client agrees to:
- Provide clear and safe access to the Site.
- Secure the Site and all materials and tools outside of working hours.
- Make decisions and provide any required information in a timely manner to prevent delays.
Insurance
Destin Constructions maintains all legally required insurances, including Public Liability Insurance and Domestic Building Insurance (where applicable). The Client is responsible for ensuring their own property and contents insurance coverage is sufficient for the duration of the Works.
Termination
Either party may terminate this Contract by written notice if the other party:
Commits a material breach of these Terms and fails to remedy it within 14 days of receiving notice. Becomes insolvent, bankrupt, or goes into liquidation.
Limitation of Liability
To the maximum extent allowed by law, Destin Constructions’ total liability for any claim under this Contract is limited to the contract price or the value of the Works that caused the claim.
Governing Law
This Contract is governed by the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
Entire Agreement
This document, together with the accepted Quotation, forms the complete agreement between the parties and overrides all previous discussions, representations, and agreements.
